1. Who we are

These Terms of Service ("Terms") govern your access to and use of the website, products, and services of Fresh & Forever Flower Inc. ("Fresh & Forever," "Endless Roses," "we," "us," or "our"), including any orders you place through our website, by phone, or in person. 2. Acceptance of these terms

By accessing our website, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Notice, which is incorporated here by reference. If you do not agree, please do not use our site or place an order.

3. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) and able to form a legally binding contract to place an order. By ordering, you represent that the information you provide is accurate and that you are authorized to use the payment method supplied.

4. Products, colors & substitutions

Flowers are natural products. The blooms you receive may vary slightly in shade, size, and form from the photographs on our website, which are intended as a representative guide. Screen settings may also affect how colors appear.

Because availability is seasonal and subject to the day's harvest, we reserve the right to substitute flowers, foliage, containers, or packaging of equal or greater value while maintaining the overall style, color palette, and feel of the arrangement you selected. Where a specific container is unavailable, a comparable one will be used.

Preserved "Forever" roses

Our forever roses are genuine roses preserved at peak bloom. With proper care — kept away from direct sunlight, water, and high humidity — they typically last between one and three years. Lifespan is an estimate, not a guarantee, and natural variation in tone or softening over time is normal and not a defect.

5. Orders & order acceptance

Your order is an offer to purchase. All orders are subject to acceptance and product availability. We will send an order confirmation by email when we receive your order; this confirms receipt but does not constitute acceptance. A contract is formed only when we dispatch your order or begin its preparation. We may decline or cancel an order at our discretion, including where an item is mispriced, out of stock, or where we suspect fraud, in which case we will refund any amount charged.

6. Pricing & payment

• All prices are listed in U.S. dollars and, unless stated otherwise, exclude applicable delivery fees and taxes, which are shown at checkout.
• We may change prices at any time, but changes will not affect orders we have already accepted.
• Payment is taken at the time of ordering through our third-party payment processors. You authorize us to charge your selected payment method for the total order amount.
• If a product is listed at an incorrect price due to a typographical or system error, we are not obligated to honor that price and will offer you the option to reorder at the correct price or receive a full refund.

7. Delivery & shipping

We offer same-day local hand delivery for eligible orders placed before the daily cut-off time (currently 1:00 PM local time), as well as nationwide shipping for forever roses and selected keepsake items.

• Accurate details. You are responsible for providing a complete and correct recipient name, address, and contact number. We are not liable for failed or delayed delivery caused by incorrect or incomplete information.
• Delivery windows. Stated delivery times are estimates and not guaranteed. Weather, traffic, courier delays, and events beyond our control may affect timing.
• Recipient availability. If no one is available to receive the order, the courier may leave it in a safe place, with a neighbor or concierge, or attempt redelivery. We are not responsible for items left at the recipient's address per delivery instructions.
• Perishable care. For shipped fresh items, prompt unpacking and care upon arrival is essential; please follow the included care instructions.

8. Our freshness guarantee

We want every arrangement to arrive beautiful. If your fresh flowers arrive damaged, wilted, or fail to stay fresh for at least five (5) days with proper care, contact us within 48 hours of delivery with your order number and a photograph. We will, at our discretion, arrange a replacement or issue a refund. For forever roses, report any manufacturing or transit defect within 7 days of delivery for a replacement or refund.

9. Cancellations & refunds

Because flowers are perishable and arrangements are made to order, our cancellation window is limited:

• Fresh orders may be changed or cancelled for a full refund up to 24 hours before the scheduled delivery date. Once preparation has begun, cancellation may not be possible.
• Forever roses and keepsake items that are unused and in original packaging may be returned within 14 days; return shipping is the customer's responsibility unless the item was defective.
• Refunds are issued to the original payment method and may take 5–10 business days to appear, depending on your provider.
• We do not refund delivery fees on completed deliveries except where required by law or where we are at fault.

10. Subscriptions

If you sign up for a recurring flower subscription, you authorize us to charge your payment method on the recurring schedule you select until you cancel. You may pause, skip, or cancel at any time before the next billing/processing date through your account or by contacting us. Cancellations take effect for the next undispatched delivery; already-prepared orders cannot be refunded.

11. Weddings & events

Wedding and event work is governed by a separate written proposal and contract that sets out the design, quantities, deposit, payment schedule, and cancellation terms. Where that contract conflicts with these Terms, the event contract controls. Deposits for event work are generally non-refundable as they reserve our team and reserve seasonal stock.

12. Gift cards & promotions

Gift cards are redeemable toward products on our website, cannot be exchanged for cash (except where required by law), and may expire as stated at purchase. Promotional codes are single-use unless stated, cannot be combined unless specified, have no cash value, and may be withdrawn at any time.

13. Acceptable use

You agree not to misuse our website, including by attempting to gain unauthorized access, interfering with its operation, scraping content, submitting false orders, or using it for any unlawful purpose. We may suspend or terminate access for any breach.

14. Intellectual property

All content on this website — including text, photographs, floral designs, graphics, logos, the "Fresh & Forever" and "Endless Roses" names, and the overall look and feel — is owned by or licensed to us and protected by intellectual-property laws. You may not copy, reproduce, or use it without our prior written permission, except for personal, non-commercial browsing.

15. Disclaimers

Our website and products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the website will be uninterrupted or error-free. Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by our negligence.

16. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or related to any order or these Terms shall not exceed the amount you paid for the order giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages, or for any loss of profit, goodwill, or opportunity.

17. Indemnification

You agree to indemnify and hold harmless Fresh & Forever Flower Inc. and its officers, employees, and agents from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of our website or products.

18. Governing law & dispute resolution

These Terms are governed by the laws of the state in which Fresh & Forever Flower Inc. is established, without regard to conflict-of-law principles. You agree that any dispute will be resolved in the courts of that jurisdiction, unless applicable consumer-protection law grants you the right to bring proceedings elsewhere. We encourage you to contact us first so we can try to resolve any concern informally.

19. Changes to these terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the latest version, and changes are effective when posted. Your continued use of our website or placement of new orders after changes are posted constitutes acceptance of the revised Terms.
